Terms of use

[1] The terms below form part of the legal agreement between the user and the “Search for cultural incentives” platform, hosted on https://apoio.art, hereinafter also referred to as the “Site” or “platform”. By accessing, browsing and/or using this Site, you – the user – acknowledge having read, understood and agreed to be bound by the terms and conditions set out below and to comply with all applicable laws and regulations. If you do not agree to these terms, do not use this site.

[2] The Terms of Use are subject to change at any time without notice. By using this Site, you agree to be bound by such revisions and should therefore visit this page periodically to determine the current Terms of Use to which you are bound.

[3] For reasons of readability, only the male gender may have been used in various texts, including this one, but the content always refers to and extends to all genders, if nothing else.

[4] Please note that the project does not intend to provide advice or monitor applications. Please consult the contact options on the page of the calls and programs mentioned. We reserve the right not to respond to requests for assistance from individuals, groups, organizations, institutions or companies.

[5] The platform does not guarantee that the information contained is free of errors, inaccuracies or omissions. Such errors, inaccuracies or omissions may refer to any content, weblinks or dates provided. The platform therefore reserves the right to correct any errors, inaccuracies or omissions and to change or update information on this Site at any time, without prior notice or record of changes made.

[6] Due to an error on our part or due to omissions or misinformation in the calls for proposals and information on grants listed and summarized on our site, it is possible that we may temporarily include a grant that is not accessible to applications from our target audience, residents and citizens of Brazil. However, as this site is purely informative, we cannot be held responsible for these situations, and it is up to each interested party to check the information provided here with the respective official sites and bodies.

[7] The platform does not make any representations or warranties about any website that you may access through this one. Any website is independent and this platform has no control over and is not responsible for the information provided or the activities carried out by any website. A link between this Site and another website does not mean that our platform endorses that website or is associated with it from a legal or business point of view.

[8] The platform disclaims any liability for any direct and indirect damage, regardless of cause, origin, nature or consequences, including costs that may arise due to the acquisition of goods, loss of profit, customers, contracts, data, working hours or any other tangible or intangible assets that may arise after access to the Site by any person, or the impossibility of access to the Site or the credit granted to any information arising directly or indirectly from the Site.

[9] The content of the Site may not be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording or otherwise, without the prior written permission of the editor of the platform. The user has no right, without written permission, to “mirror” any material contained on this Site on any other server.

[10] The Site, as well as any software necessarily used in relation to it, may contain confidential information protected by current intellectual property legislation or any other rule or regulation. Therefore, unless otherwise stipulated, the copyright of the contents of the CURRENT SUPPORTS and CLOSED SUPPORTS, LINKS, NEWS and ABOUT sections belongs to the platform or the organizations indicated. The copyright of content provided in the REPORTS section, whether in text, image, audio or video format, belongs to the people who made this content available. Some images are subject to theGNU General Public License. The authors of the images are duly credited.

[11] The purpose of the REPORTS section is to inform users about the application process and about the stay of artists and professionals in the field of culture and the creative economy – from the categories covered by the site – in France and Germany, made possible through scholarships, grants and other support, subsidy and incentive programs, about the creations directly resulting from this, and the connections, especially professional ones, that were made possible.

[12] With your submission of REPORTS via the contact form, you agree that the materials transmitted, in video, audio, text or image format, and the ideas and information contained therein, will be treated as non-confidential and may be published on this platform. With your submission, you also accept that this does not establish a right to publication: it is the free choice of the platform’s editorial staff which of the materials received, including which part of them, will be published. On the other hand, it is the right of the authors who have submitted stories to request the removal of the material published on the Site. In this case, we will make our best efforts to respond to the authors’ request in the shortest possible time, bearing in mind, however, that it is common for these steps (changes or corrections to already published material) to take a certain amount of time to be carried out, which does not constitute a breach of any duty on the part of the platform.

[13] For any information, materials, data and ideas submitted via the “CONTACT US”, “SEND YOUR REPORT” and “NOMINATE A SUPPORTER” contact forms, it is important to note that the submission does not imply the possibility of remuneration, the platform being a non-commercial initiative and free of charge to the public.

[14] The Terms of Use shall be governed by and construed in accordance with local and national laws, notwithstanding any principles of conflicts of laws. If any part of the Terms of Use is unlawful, void or unenforceable, that part shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

[15] We strongly recommend that, in addition to reading and understanding these Terms of Use, you also read and understand our Privacy Policy, as your continued use of this website necessarily implies your acceptance of both documents.
